On January 21, 2014 the Law №198-FZ “On Amendments to the Federal Law “On Physical Culture and Sport in the Russian Federation” and Certain Legislative Acts of the Russian Federation to prevent wrongful impact on the results of the official sport events” will come into full force.
This law has been passed last summer and has shaken up both the betting business representatives and the players.
We would like to remind the key changes introduced by the Law №198-FZ:
Identification of the players
Accepting the bets and paying the winnings can be carried out only after identifying the player. Officially approved list of the documents establishing identity has not yet been adopted in the Russian Federation. The documents complying with the current legislation include the passport of a citizen of the Russian Federation, diplomatic passport, military identity card, seaman's book and other. Due to the absence of governmental regulation it is expedient to ask the player to provide the passport complying with the current legislation.
Rub90 offers the partners several identification options. The cashier registers the player in the system using his passport data and the player signs the agreement on the use of his personal data. All the bets of the player are tied to his account. The opportunity to take the photo of the player and to save the copy of the player’s passport in an electronic format will be provided in the near future.
In the first scenario to bet the player provides the cashier with his full name or passport number and submit identity document. The cashier finds the player in the system and accepts the bet tying it to the client.
In the second scenario after the registration the cashier provides the player with the card which enables the player to bet at the cash desk or in the terminal. At the cash-desk the player must submit the card and the passport with every bet. If the player uses the terminals he submits his passport only depositing or withdrawing money from the account. Therefore using terminals simplifies betting both for the bookmaker and the player.
The contractual matches
In December the Government of the Russian Federation adopted decree clarifying the rules on providing information on the bets on matches ended up with the unpredictable results. However not all terms used in the law have been clarified. It is not clear which of the results of the events should be attributed to the “unpredictable”. Therefore bookmakers will stay independent in determining such events until the official explanation is issued.
The flow chart presents providing information on the bets on the presumably contractual matches and is published in “The Decree of the Russian Federation Government on the information on the contractual matches”.
Taxation
The tax in the amount 13% will be charged from every winning of the player. In determining the tax base for income in the form of winning the sum of the winning is included minus the sum of the bet. The bookmaker withholds the tax by the payouts, records and transmits it to the Government budget in accordance with the Russian Tax Code requirements. Cash payments must be done using cash registers but payouts can be executed using cash receipt. Rub90 software automatically records all the player’s bets enabling withholding tax by payouts.
